1st Ecommerce site got penalized, can we start a 2nd one?

Hello,
A client's first site got penalized by Goolge Penguin. It has recovered through cleaning up backlinks, but not to where it was before. It is 2nd and 3rd for several money keywords, but is far less successful than before penalization.
We are starting a second site. Here's the important steps to mention
The new site shows up first for it's domain name, and it has 30 pages indexed. It shows up NOWHERE for our leading search term. Out other site has a blog post that is 3rd for that search term.
We are using new categories and new organization.
We are using a different cart solution
We are adding all unique content
The home pages and some of the product pages are very thorough. We are adding comprehensive products like nothing else in the industry (10X)
We plan on adding a very comprehensive blog, but haven't started yet.
We've added the top 100 products so far. Our other store has 500.
There's a lot of spam in the industry, so sites are slow to rank.
Our category descriptions are 500 words
Again, all unique content. No major errors in Moz Campaign tools
Just a few categories so far, we're going to add many more.
Same Google Analytics account as our other site
It looks like we should eventually be on page 3 for our major search term. Again, we're nowhere for anything right now.

Have you seen that Google will not rank a second site because it's from the same company and Google Analytics account, or does Google let you rank 2 sites in the same industry? We are hoping it's just slow to rank.
If you can rank 2 sites, what are your best recommendations to help show up?

If you launch a duplicate site, Google will sniff it out and neither site will rank because they will treat them as one site with duplicate content. I had an issue like this for 2 legitimate sites with the same content and different brands. When we went with cross domain canonicals, we started ranking in a big way.
Without improving Backlinks, Content Quality and UX, your site will not achieve it's old rankings. The site was getting ranked because of link spam, and when those links spammy links go bye-bye your rankings go with them.
With the new "kinder & gentler" penguin, stick to 1 site and focus on making the current site awesome and acquiring high quality backlinks.

Is this campaign of spammy links to non-existent pages damaging my site?
My site is built in Wordpress. Somebody has built spammy pharma links to hundreds of non-existent pages. I don't know whether this was inspired by malice or an attempt to inject spammy content. Many of the non-existent pages have the suffix .pptx. These now all return 403s. Example: https://www.101holidays.co.uk/tazalis-10mg.pptx A smaller number of spammy links point to regular non-existent URLs (not ending in .pptx). These are given 302s by Wordpress to my homepage. I've disavowed all domains linking to these URLs. I have not had a manual action or seen a dramatic fall in Google rankings or traffic. The campaign of spammy links appears to be historical and not ongoing. Questions: 1. Do you think these links could be damaging search performance? If so, what can be done? Disavowing each linking domain would be a huge task. 2. Is 403 the best response? Would 404 be better? 3. Any other thoughts or suggestions? Ajax Pagination on Ecommerce category pages - Good or Bad?
We have an ecommerce site. We installed an AJAX feature that when you scroll down to say, the end of 6 rows of products, it loads another page below the seam. Question is, is this good or bad for SEO? Any tests you can suggest? Thanks Ben

How to stop links from sites that have plagurized my blogs
I have been hit hard by Penguin 2.0. My webmaster explains that I have many links to my articles (a medical website with quality content) from "bad sites." These sites publish my articles with my name and link to my site and it appears I have posted my articles on their site although I have not posted them-theses sites have copied and pasted my articles. Is there a way to prevent sites from posting my content on their site with links to my site?

People buying links to their profiles on my site
As we have a major Penguin update looming in the background, I am looking for expert advice on how to deal with professionals buying into link programs whether they are doing it deliberately or not. Our site provides detailed profile information on hundreds of 1000's of professionals and some professionals apparently believed that buying into link program will lift their profile in the SERPS. About 10 professionals have paid shady link building companies to buy links to their profiles on our site. The biggest offender bought over 1,500 links to his profile. Aside from adding the known toxic links to our disavow file, what else can we do to avoid any link penalties? I can think of three distinct options and would love to hear feedback especially based on actual experience. Option 1. 404 the existing profile - "http://www.anysite.com/jones_smith" and create a new URL "http://www.anysite.com/jones_smith_1". Option 2. Keep the existing URL and fully rely on the disavow file. Contact the professionals and kindly ask them to stop buying links and to contact their link building companies to remove the links. Any other ideas?

Switching existing website to a Wordpress Site and afraid of losing top spot
I am going to be switching my current site from a standard html site to a wordpress site. I'm kind of paranoid of losing my top spot for the keyterms. Can't figure out how my competitor has so many links
I suspect something possibly black-hat is going on with the amount of inbound links for www.pacificlifestylehomes.com ( http://www.opensiteexplorer.org/links?site=www.pacificlifestylehomes.com ) mainly because they have such a large volume of links (for my industry) with their exact targeted keyword. Can anyone help clear this up for me?
