Is Google's reinclusion request process flawed?

We have been having a bit of a nightmare with a Google penalty (please see http://www.browsermedia.co.uk/2012/04/25/negative-seo-or-google-just-getting-it-painfully-wrong/ or http://econsultancy.com/uk/blog/10093-why-google-needs-to-be-less-kafkaesque for background information - any thoughts on why we have been penalised would be very, very welcome!) which has highlighted a slightly alarming aspect of Google's reinclusion process.
As far as I can see (using Google Analytics), supporting material prepared as part of a reinclusion request is basically ignored. I have just written an open letter to the search quality team at http://www.browsermedia.co.uk/2012/06/19/dear-matt-cutts/ which gives more detail but the short story is that the supporting evidence that we prepared as part of a request was NOT viewed by anyone at Google.
Has anyone monitored this before and experienced the same thing? Does anyone have any suggestions regarding how to navigate the treacherous waters of resolving a penalty?
This no doubt sounds like a sob story for us, but I do think that this is a potentially big issue and one that I would love to explore more.
If anyone could contribute from the search quality team, we would love to hear your thoughts!

I agree that they must be swamped and most of the 'complaints' you can see on the Google forums fully deserve to be penalised in my humble opinion, but I think that the total lack of communication is more damaging than helpful.
If they want to improve the web, why do they not give more details about what is causing the problem? By being more transparent and helping webmasters to eradicate spammy techniques, everyone will be forced into improving their sites for all the right reasons.
If they don't have the resource to handle the reinclusion requests, then they shouldn't have it as an option.
I still feel that it is very poor not to even look at the files that were prepared - that shows a lack of respect.
I agree that it is likely to be something simple. The 'spike' theory is still the strongest contender for me, due to the timings of events, but that is alarming if it proves to be true as we were effectively penalised for doing exactly what Google encourages (creating good content that will naturally attract links).
Another possible cause is the fact that we have got a number of directory links over the years. Whilst I have never considered these to be high quality links, I have never seen Google saying that you shouldn't submit your site to them (indeed, they used to actively suggest that submitting to Yahoo! was a good idea) and it is a way for Google to outsource some human assessment of sites (assuming that the directories do check your sites).
If it is the directories, then the door for negative SEO is so wide open that it is alarming. As many have said, completely ignoring such links would be better than penalising you.
We are still no closer to understanding what we have done wrong, despite every effort to adhere to the guidelines and a lot of work trying to audit / document our link profile. With very little faith in the reinclusion process, where can we possibly turn to now?
We will see. There were multiple views of the open letter from Google, so somebody somewhere has seen it and I just hope that there is some form of response.
The irony is that we spend most of our life defending Google and encouraging clients to improve what they are doing online. On this occasion, I really find it hard to defend them. I appreciate that we are a drop in a mighty ocean, but the principle is one that I think is an important one and one that I will pursue.

Not sticking up for them but you have to appreciate the amount of people that would probably try to send them all sorts of viruses anyway they can, also they probably don;t have or want to take the time looking at everyone so closely, basically they will just see if the offending stuff is still there, if it is they won't give you any love.
Honestly, it's probably something so simple you have overlooked it. Keyword ratio's above 6% can be taken as spam depending on content amount, non relevent link coming in/going out, links from already penalzed sites, anything unnatural is now what google has been focusing on, not just backlinks, so go through your site, obviously the HP is the first point to start at, if you are really sure there is nothing going on in the way of spaminess or over optimization, comb through your other pages. It will usually be a problem one your best ranked pages. Or, ex best ranked pages if you have been hit with a penguin slap.

Can subdomains hurt your primary domain's SEO?
Our primary website https://domain.com has a subdomain https://subDomain.domain.com and on that subdomain we have a jive-hosted community, with a few links to and fro. In GA they are set up as different properties but there are many SEO issues in the jive-hosted site, in which many different people can create content, delete content, comment, etc. There are issues related to how jive structures content, broken links, etc. My question is this: Aside from the SEO issues with the subdomain, can the performance of that subdomain negatively impact the SEO performance and rank of the primary domain? I've heard and read conflicting reports about this and it would be nice to hear from the MOZ community about options to resolve such issues if they exist. Thanks.

Magento 1.9 SEO. I have product pages with identical On Page SEO score in the 90's. Some pull up Google page 1 some won't pull up at all. I am searching for the exact title on that page.
I have a website built on Magento 1.9. There are approximately 290,000 part numbers on the site. I am sampling Google SERP results. About 20% of the keywords show up on page 1 position 5 thru 10. 80% don't show up at all. When I do a MOZ page score I get high 80's to 90's. A page score of 89 on one part # may show up on page one, An identical page score on a different part # can't be found on Google. I am searching for the exact part # in the page title. Any thoughts on what may be going on? This seems to me like a Magento SEO issue.

Why isn't my site being indexed by Google?
Our domain was originally pointing to a Squarespace site that went live in March. In June, the site was rebuilt in WordPress and is currently hosted with WPEngine. Oddly, the site is being indexed by Bing and Yahoo, but is not indexed at all in Google i.e. site:example.com yields nothing. As far as I know, the site has never been indexed by Google, neither before nor after the switch. What gives? A few things to note: I am not "discouraging search engines" in WordPress Robots.txt is fine - I'm not blocking anything that shouldn't be blocked A sitemap has been submitted via Google Webmaster Tools and I have "fetched as Google" and submitted for indexing - No errors I've entered both the www and non-www in WMT and chose a preferred There are several incoming links to the site, some from popular domains The content on the site is pretty standard and crawlable, including several blog posts I have linked up the account to a Google+ page

My Website Has a Google Penalty, But I Can't Disavow Links
I have a client who has definitely been penalized, rankings dropped for all keywords and hundreds of malicious backlinks when checked with WebMeUp....However, when I run the backlink portfolio on Moz, or any other tool, they don't appear anyone, and all the links are dead when I click on the actual URL. That being said, I can't disavow links that don't exist, and they don't show up in Webmaster Tools, but I KNOW this site has been penalized. Also- I noticed this today (attached). Any suggestions? Can I, in Google's good graces, check for Googlebot to turn on/off tracking parameters in URLs?
Basically, we use a number of parameters in our URLs for event tracking. Google could be crawling an infinite number of these URLs. I'm already using the canonical tag to point at the non-tracking versions of those URLs....that doesn't stop the crawling tho. I want to know if I can do conditional 301s or just detect the user agent as a way to know when to NOT append those parameters. Just trying to follow their guidelines about allowing bots to crawl w/out things like sessionID...but they don't tell you HOW to do this. Thanks!

Bing flags multiple H1's as an issue of high importance--any case studies?
Going through Bing's SEO Analyzer and found that Bing thinks having multiple H1's on a page is an issue. It's going to be quite a bit of work to remove the H1 tags from various pages. Do you think this is a major issue or not? Does anyone know of any case studies / interviews to show that fixing this will lead to improvement?

.GOV Link - same impact on my site's rankings whether link to home or Gov related category?
I own a job site and I am about to get a link from a .GOV. My site has a category called "State Jobs". Should I ask the ".Gov" to link to my homepage or to the state job page and use the anchor text "State Jobs". I understand "State Jobs" page would get a big kick by that being the anchor text and linking to that specific page, but the question I have is this: for my site as a whole (homepage and various categories) would they get around the same "push up" whether the linking is to 1) my homepage with anchor text being my site's name or 2) to the state job specific page and in this case the anchor text would be "State Jobs"? thank you

What's the "most valuable indirectly related skill" to SEO worth learning?
Hi, All! I have a little time on my hands that's not taken up by client work or our own marketing. What would you say is a skill worth learning during that time? My background is not techie, so while I've picked up a teeny bit of knowledge about code, etc. on the way, I still don't really know how to code, use APIs, etc. So I was thinking something along those lines, but anyone have specific suggestions?
