Hidden links in badges using javascript?

I have been looking at a strategy used by a division of Tripadvisor called Flipkey. They specialize in vacation home rentals and have been zooming up in the rankings over the past few months. One of the main off-page tactics that they have been using is providing a badge to property managers to display on their site which links back.
The issue I have is that it seem to me that they are hiding a link which has keyword specific anchor text by using javascript. The site I'm looking at offers vacation rentals in Tamarindo (Costa Rica). http://www.mariasabatorentals.com/
Scroll down and you'll see a Reviews badge which shows reviews and a link back to the managers profile on Flipkey.
**However, **when you look at the source code for the badge, this is what I see:

Notice that there is a link for "tamarindo vacation rentals" in the code which only appears when JS is turned off in the browser.
I am relatively new to SEO so to me this looks like a black hat tactic. But because this is Tripadvisor, I have to think that that I am wrong. Is this tactic allowed by Google since the anchor text is highly relevant to the content? And can they justify this on the basis that they are servicing users with JS turned off?
I would love to hear from folks in the Moz community on this. Certainly I don't want to implement a similar strategy only to find out later that Google will view it as cloaking. Sure seems to be driving results for Flipkey!

Thanks Carson. I would tend to agree were it not for the fact that Tripadvisor is so adept at SEO. Not sure how to rationalize this behavior alongside their reputation. Assumed that I was missing something...

It's cloaking, plain and simple - showing one thing to the search engines and another to the user. The people embedding these widgets may think they're just promoting their own profiles, but unwittingly they're telling Google that they endorse a search page.
Don't tell me it's for (the .1% of) users with their JavaScript turned off. If that were the case, either the widget would also include the commercial link or the JS-disabled version would include the profile link.
While Google's algorithm tends to take it easier on sites with established link profiles, this sort of thing may justify manual action. Not only is it a risky tactic, but the intent-swapping implementation show very bad faith.
I'd advise any site owner not to use the badge, as a manual quality reviewer might mistake it for cloaking on the part of the publisher. Eventually, these links will either be devalued or outright penalized, as they're in direct and blatant violation of Google's terms of service.

I haven't looked at flipkey yet, if you looked at my badges though you can see a different anchor text is created each time and points to internal pages, which may not work for all businesses, we are all long tail. That being said, the way they were generated (silly search process) was not was was asked for and a perfect example of dev delivering something completely different, as a result of the generation process they have not been very successful, but the final code that is generated is good SEO.
I would use different anchor texts for each badge and not point to the homepage, point to a LP instead so you can 404 the page (which drops the links pointing to your site automatically by changing the URL) if you point to the homepage you'll need to contact webmasters and request takedowns prior to reconsideration request if you get hit.

Check out the "How much is my site worth?" sites - They usually give you a widget to embed once you "evaluate" your site worth.

Do you know of any other examples in which badges are used in this manner?

Thanks Irving! Are you implying that a small number of badges (ie. <10) with the same anchor text won't hurt them? In almost all cases, the anchor text will be long tail and not be overdone.
I took a look at Vitals and how you generate badges using the doctors name as anchor text. This is also very long tail. Do you see this as analogous to how Flipkey is using badges?

since badges often go globally on sites they're probably going to hurt themselves and get penalized for that anchor text since it will be overdone.

Embedding links into widgets (especially keyword rich, hidden links) is considered a link scheme by Google. TripAdvisor will not be penalized (at least algorithmically) because they have a very strong link profile. A small site may be hit with penguin for these actions.
Manually, G may or may not decide to penalize them. Personally, I don't think its a bad thing. They are providing a service and show a link that would allow someone to get more info in case their JS is off (as you mentioned).
If you were to make a widget, I would link back with your brand name. It can be an excellent way to build links as long as you do it right.

Back links to pages on our site that don't exist on forums we haven't used with irrelevant product anchor text
Hi, I have a recurring issue that I can't find a reason for. I have a website that has over 7k backlinks that I monitor quite closely. Each month there are additional links on third party forums that have no relevance to the site or subject matter that are as a result toxic. Our clients site is a training site yet these links are appearing on third party sites like http://das-forum-der-musik.de/mineforum/ and have anchor text with "UGG boots for sale" to pages on our url listed as /mensuggboots.html that obviously don't exist. Each month, I try to contact the site owners and then I add them to Google using the disavow tool. Two months later they are gone and then are replaced with new backlinks on a number of different forum websites. Quite random but always relating to UGG boots. There are at least 100 extra links each month. Can anyone suggest why this is happening? Has anyone seen this kind of activity before? Is it possibly black hat SEO being performed by a competitor? I just don't understand why our URL is listed. To be fair, there are other websites linked to using the same terms that aren't ours and are also of a different theme so I don't understand what the "spammer" is trying to achieve. Any help would be appreciated.

What to do with these toxic links?
Back in July I had posted here that I thought someone was doing negative SEO against us. We monitor our links on a daily basis, and a lot of toxic links came in quickly within a few days. So we were pro-active and ended up disavowing those links soon after we saw them. Shortly after that our ranking start to drop and we lost a good amount of traffic, though I do not know if its really connected since we only disavowed those toxic links and we weren't ranking FROM those links since they were disavowed so quickly. Now, its happening again. 20 new inbound domains linking to us from complete crap websites with crap content and not done by us. I want to disavow them, but I am thinking that maybe the first time we disavowed the links, it hurt us, and maybe disavowing now will hurt us further? I think Google should be able to filter out this crap but who knows, too much depends on this being handled correctly. Better ranking competitors have paid links from blog pages
I have a trial of all the tools at the moment and it's a lot of fun. I have been delving into site explorer and found that some competitors have links to them from obvious seo promoting paid blog sites. One has no other links except a paid for blog from a site that openly admits it offers paid marketing and they shot up to 4th on page one for a main keyword phrase. The info from moz and matt cuts video's say not to do this, but it's so tempting. The blog is well written, while I sit here and do the right thing, my competitors have page one. If the blog is well written and is meaningful is it OK and if google ever decide it's paid and don't like it, wouldn't it be better to be page one for 6 months and then recover? I'd love to give the link to the seo, blogger thingy but don't want to come across as promoting it in any way. I am sure there are loads of them anyway.

Using Yext - Opinions? Thoughts? Harmful effects on SEO?
Hi All, Does anyone have any experience using Yext? We have 36 locations across the US and I think it would be great to get our local listings knocked out efficiently. Can anyone provide information on the directories they list you in (perhaps Google places listings, for example)? Also, can anyone provide feedback as to whether or not there is any harm with blasting so many directories at once? I don't want to do anything that might harm our SEO rankings or provide low quality links. Thanks in advance!

My words are competitive words and a few of them are finally increasing to top 500 and a few in top 100. My current MozRank for my domain is 2.28, but my mozbar shows my homepage to be MozRank to be 3.35 Link Building Plan -Around 50 Directory submissions to high PR directories and high MozRank domains Free listings Paid Listings -3-5 articles written for guest posts Around 25 Local Business directories such as brownbook.net, whitepages, etc -Around 20 dofollow forum profile creation and backlinks from signatures -Squidioo Lens Creation( I will be creating high quality content related my website which would be web design, internet marketing, seo services.) -Hubpages Creation My question is should the content used on squidioo be 100% original, like can I post the content to other directories as well? -Article Directories Okay so from what I've read this is method doesn't really give much benefit with the recent updates, is this true or should I still at least submit some articles to article directories. I am also confused wouldn't distributing your articles to article directories be considered duplicate content? 20-25 Blog Comments on related blogs that support dofollow blog commenting, also will build some nofollow blog comment links for link diversity

Hi, I am using a plugin in wordpress that make auto link for some certain keywords in my site suppose: My site is example.com My important keyword is: sample and across the domain example.com through out the content if there is the word: sample it is linked automatically to example.com I like your opinion about this practice, if it may carry any kind of punishment by SEs? Would linking out to a gambling/casino site, harm my site and the other sites it links out to?
I have been emailed asking if I sell links on one of my sites. The person wants to link out to slotsofvegas[dot]com or similar. Should I be concerned about linking out to this and does it reduce the link value to any of the other sites that the site links out to? Thanks, Mark
