Should this site be punished?

Every summer for the past 4 years one of our customer's competitors suddenly has a big jump in Google's (.co.uk) rankings for some of the main industry phrases, particularly "air conditioning".
We were always under the impression that they bought links before the busy summer season, as they have these strange massive jumps in the rankings. (for the rest of the year they often drop down) I recently checked out some of the back-links going to their site and noticed something I'd not seen before. Of the (approx) 480 links that showed up, around 80% of the SourceURL's ended with "?Action=Webring" (see 1st attached image).
To me it doesn't look natural at all and I'm surprised that Google hasn't picked up on. Their site is www.aircon247.com. It had been mentioned to me that this may be to do with link sharing sites (which I assume is black-hat) but I'm not 100% sure that they are doing this.
They also have an identical long spammy-looking footer at the bottom of every page which is clearly only for search engines to see. We reported it to Google a year ago but no action was taken. Do you think that it is acceptable to have it on every page? (see 2nd attached image)
I would be interested to know your thoughts on both of these, and whether this would be a dangerous tactic to try and emulate?

Yes they "should" be punished. But they probably won't, at least not for a long time. To Google's own detriment they don't act on spam reports nearly enough, which results in spam working more than it should, which results in more spam... and frustrated competition who were playing fair deciding "If you can't beat them, join them". The all the combined intelligence over at Google you'd think they'd figure out that for long term benefits it's best to act on the spam reports instead of just gathering data from them.

My personal view, although I'm sure some will disagree and stamp on my toes, is that complaining about competitor tactics is a waste of time. The chances of Google adding a manual penalty based on your report is very, very slim so your time is better spent working out ways to beat them the right way.
Looking at their backlink profile, there are a huge amount of paid links, general directories and not really much else. With that in mind I'd say that although they have a decent amount of linking domains it should be possible to beat them without using the same tactics.
Another thing to remember is that even if you did go down the route of trying to copy their method you wouldn't be guaranteed to succeed so might waste a load of time and money with nothing to show but a penalty.
As for the spammy footer... it might be adding some benefit to their site but I doubt it's having a huge impact... and it just looks horrid!

Direct To Site Traffic Decline 2

Pharma Hack/Grey hat SEO. Cannot get site to rank, tons of incoming bad links
I have been working on a website trying to get it to show up in the SERPs again. It is being indexed which is great, it has some errors that I'm fixing now. But for the most part it should be ranking. It don't show any penalties going on, but when I did a backlink search we keep getting the cialis, viagra etc inbound links. First thought was Pharma Hack. But it's not a WP site and I recently rebuilt it. So whatever bad code could have been there it's not anymore. It doesn't show up in google either for the search site:www.mysite.com viagra cialis etc... So I'm wondering if anyone has any insight in a direction to point me? I don't understand what would be causing this to still not rank. Only thing it ranks for is it's name. Any suggestions would be very appreciated.

Non Manual penalties, should I trash my site?

I have written to google previously and they told me that there are no manual penalties on the site. I give up... If I 301 redirect my penalised site to my new one am I just poisoning my new site as well? I could get the links changed instead. Why should my site be treated as trash by google? I have in the past employed a SEO firm and if I search for "If you are looking for the top provider of digital signage in Australia, visit today" I find 70 absolute crap links to my site. I have disvowed them, there must be more links somewhere but I have no money or time to chase down site owners to remove them when I do not even know if I can get them all and have no guarantee that this will even help.. So bottom line, do I need to junk my www.adserve.com.au site? There is no getting away from what some SEO company has spammed in the past?
And again, using a tool to hunt down these spam links and try to get them removed will tie up my own time that needs to be spent on developing my software and I have no cash to pay people to do this for me. [edited by staff because line breaks weren't showing]0 -
Massive site-wide internal footer links to doorway pages: how bad is this?
My company has stuffed several hundred links into the footer of every page. Well, technically not the footer, as they're right at the end of the body tag, but basically the same thing. What happens when content on your website (and blog) is an exact match to multiple sites?
In general, I understand that having duplicate content on your website is a bad thing. But I see a lot of small businesses (specifically dentists in this example) who hire the same company to provide content to their site. They end up with the EXACT same content as other dentists. So, overall, doesn't this make the content on these blogs irrelevant? Does this hurt the SEO on these sites at all? What is the value of having completely unique content on your site/blog vs having duplicate content like this?

Google-backed sites' link profiles

Does this imply that the average root domain linking to the taxdonut site does so with 2857 links? The sites have no significant social media stats. The sites are heavily inter-linked. Interestingly, they've managed to secure links on quite a few UK local authority resources pages - generally being the only commercial website on those pages.

Penguin destroys 1 of my sites! Any ideas why the other was spared?
I have 2 main sites for my business. One is a creaky homestead site about 4 years old Another is a much more sophisticated wordpress site now almost 2 years old. That site's traffic steadily increased until May of 2011 when it suffereed a 25 to 30% decline probably due to Panda. I did all of the recommended fixes with little effect until about 3 months ago when its traffic started going up again and had almost a complete recovery until last week when my traffic is down about 95%. I strongly suspecct the penguin. Interestingly, my old site has been virtually unaffectted even though bost sites are fairly similar, on both sites I started with a lot of directory links including DMOZ, Yahoo, BOTW, some strong lawyer sites like NOLO.COM, Lawyers.com, and others not so strong but I tried to get the best directories I could find. Then I started getting a lot of natural links but some of these aee pretty junky sites and scraper type sites. I am curious if anyone has any thoughts on why www.uncontesteddivorce-nyc.com was hit so hard while www.affordable-uncontested-divorce.com is unscathed. The newer site has, accoring to majestic seo and market samurai, around 35, 000 backlinks, while the older site has around 3500. Thanks, Paul
