Can you rank for copyrighted/trademarked words that became generic terms?

Hi,
As everyone knows, lots of generic terms we use everyday (depends from one country to another obviously) are trademark terms and technically protected.
Some examples here and there.So my question is ... are we free to rank (or try to at least!) for some of these keywords?
Some of these keywords vastly outranked their original generic terms and there is little to no value trying to get traffic from the latter.More specifically what about the keywords such as spin, spinning etc.?

So in terms of whether you are allowed to try to rank for brand name/trademarked keywords the answer is yes, absolutely. Google makes decisions about which sites it thinks are most relevant for a search and you don't have any responsibility to shy away from that attempt.
In terms of whether it's possible for you to rank for those keywords, that's actually kind of related to the point above. Google decides what should rank based on best user experience. If Google has really strong evidence that whenever someone searches a particular term they are looking for a specific brand it'll be very hard for you to break into that. However, as you've mentioned, there comes a time when a term becomes generic enough that users aren't necessarily searching for the brand, that's when you'll have more and more chance with pages using the term as a generic term. You can fairly quickly check by just Googling the terms and seeing what comes up. For example, when I search "spinning" the fourth text result is "Boom Cycle" - sounds like it doesn't just have to be a brand called "Spinning" for that term. If on the other hand you Google Apple - it's pretty clear Google thinks there's only one topic that's relevant as a result.
If it's a term you think your users will be searching for, create some content for it. If it's a stretch to think you'll rank, create something good but not terribly time consuming and go from there. If it looks like the only content showing up is about this brand, consider creating a post about the differences between that and what you offer, as a way to seem a bit more relevant for Google.

Need advice w/ keywords & content to get started with SEO on my own website
I am a real estate agent, marketing properties to Germans moving to / buying an overseas home in my country. I inquired with a few different SEO agencies and I cannot afford their services, $3000+ a month and my market is not huge as you will see in the search data below. (countryname house near the sea buy) the first 5 results are taken by big portals, just the top one has done any optimization at all as you can see the competition is pretty lame, just some of them are doing any SEO, pretty badly (including spammy links), still rank. The way it seems, there are 4 main categories to optimize for: Properties Houses Apartments 'Move to countryname' information Should I optimize my homepage for a 'property' term, 3 other pages for 'house', 'apartment, and 'info' terms? How do I pick keywords to optimize for, esp. considering that they are basically the same e.g.: house in countryname buy countryname house buy house countryname buy or property countryname countryname property property in countryname ...and should I pick just one? What sort of content could I include in a "buy a house in countryname" type of page and how do I write around such keywords? I am having an issue finding examples to follow as there is no competition to emulate and the other markets/countries are dominated by large portals which also seemingly get ranked based on size / authority. Beyond that there is virtually no interest in the country = no traffic, besides general bs such as the language, the weather and such where there are a bunch of huge websites on the first page - so I am not sure what content could I use to drive traffic. I will come up with something, but there are no obvious ones.. My domain name is 1 year old, I have no links yet. Moz reports Page Authority 5, Domain Authority 2 for my domain. Should I 'nofollow' the pages on my site I want to rank the highest??

How reliable is GWT's keyword data & what is the most accurate way of determining keywords you currently rank for?
I have been monitoring the query data (keywords, average position, CTR, etc.) in GWT, but sometimes the ranking data seems off. I filter the dates for the past week, so it is the most recent. I manually check some of the rankings and they are way off. Does anyone have feedback on this? If you have access to multiple domain data, that would be great. What is the most accurate way of determining keywords you currently rank for? I have also used keywordspy, and that is off too!

How do I make sure my homepage ranks better than my 2nd page when I need the same keywords for both? I don't want them competing against each other for keywords.
I seen here on SeoMoz something about more than one page having the same keywords so they don't compete against each other for the same keywords that makes sense to me. But I would like my main page (homepage) to be ranked better over time rather than the 2nd page or do I just not care about the second page ranking at all and don't SEO the page very well? ,Both pages have similar content so I need the keywords for both. Say you are looking at a bunch of keywords and you think a competitor ranks for one of them. Is there any simple tool you can use to 1. put in keyword 2. put in domain of site RESULT - it tells you exactly where the site ranks. Like **The site UpperYupper.com shows up on Page 3 at position 35 for the keyword "yupper undies" **
