Wordpress themes causing google penalty(need experts to settle a debate)

Hi, I have been having a disagreement with another online marketing company. We are both promoting the same product under a different brand name but we ended up using the same theme to build our WordPress sites off of but in no way is the content the same.
They are telling me that using the same theme in the same industry will cause a Google penalty. I do not believe this and do not see this causing a problem. The sites are relatively new so there is no proof of traffic dropping or penalties as of yet.
What is everyone's professional opinion on this? Can a WordPress theme cause duplicate content penalty? If so would that not mean that anyone using themes will have some sort of penalty?

This is exactly what I thought I am not sure why they are so confident that this will cause a penalty. The structure of the sites are definitely different a no links have been made between them as they are essentially two site competing in the same market under different brands.
I am going to send them this thread so I can finally end this ongoing debate. Its a waste of my time.

The theme generally doesn't matter at all. As long as the content is unique on your site, then there's no problem whatsoever. Like previously mentioned, there are plenty of people using the same WordPress theme, and it's the content that's unique, not the theme.

It's a pretty straight forward 'no' Tyson. If all that is used that is the same is the theme, there is no penalty to be handed out here.
If they are concerned about it, tell them to change their theme, but you don't need to worry about this at all

I think that if you have completely different content this should not be an issue.
You should also notice you guys are not
- using the same phone / visible email address
- linking between each other (tough its only 2 sites)
- have the exact same structure
My other recommendation is that one of you change the structure (not the theme)... each theme - or at least the good ones allow you to create a different structure, different widgets, different icons and similar structure related items.
For example you can use additional tabs in your homepage, use different widgets in your footer and so fourth.
Keep in mind that many people buy the same theme and in a world where themes are content related in many cases meaning real-estate themes, transportation themes and so on it not logical that Google would rate a site just based on the theme.

Hiding content until user scrolls - Will Google penalize me?
I've used: "opacity:0;" to hide sections of my content, which are triggered to show (using Javascript) once the user scrolls over these sections. I remember reading a while back that Google essentially ignores content which is hidden from your page (it mentioned they don't index it, so it's close to impossible to rank for it). Does anyone know how to find functions/codes/etc in WordPress?
Right now, I'm working on solving a relatively easy WP issue (easy, because someone told me what to do. Thanks iNetSeo). I have to replace: <span class="post_date"></span class="post_date"> and replace it with <span class="post_date date="" updated"=""></span class="post_date> But, I can't find the "_<span class="post_date">"</span class="post_date">_For a number of my WP problems, the hardest part is just located the code/function/markup I need to replace. Does anyone know where this might usually be stored on a website? Also, does anyone know if there's any tool that would allowed to just put "various function" in a search box, and wordpress take you to where it was on the backend of your site, so you could edit it? I included a screenshot of our editors, but I already opened them all, pasted the code in Ctrl-F to no avail, but maybe I missed something. Thanks for helping with my frustrating scavenger hunt! Do you know any tool(s) to check if Google can crawl a URL?
Our site is currently blocking search bots that's why I can't use Google Webmaster Tools' URL fetch tool. In Screamingfrog, there are dynamic pages that can't be found if I crawl the homepage. Thanks in advance!

Google Malware Message
*Update 9/19/2013 So I finally have more details the site is a joomla site and is hosted on godaddy. The weird thing is the malware message only appears when browsing the site in chrome it comes up fine in internet explorer any specific reason why that would be? Also we noticed that on the joomla template there were about 6 scripts after the tag that were adult site related and have nothing to do with our site, any ideas? I appreciate all/any suggestions and or advice. Thank You. I had a client recently pay about $300 for a site design that she hosted on go daddy. This is the site www.shirianfabric.com can anyone tell me why this would happen its only been live for about three months and out of no where we get this message? My client is thinking maybe the designer inserted some kind of malicious code?as he is now charging a couple hundred to fix the issue. Is there any way to look further into this? Im not sure a webmasters account was ever set up for this site so any advice would be greatly appreciated. Thanks.

Finding a good wordpress web developer for SEO fixes
I have gotten a good audit done of my site now it is time to get the fixes done. I have a developer I worked with for a long time that is good at coding and fixes on my site. However I am not confident in his abilities to execute some of the seo changes that need to be done. Their are some common stuff he can tackle but when it comes to GWT and proper handling of 404's and 301's and other seo tasks I am not sure if he is the right choice.Maybe due to a lack of experience of dealing with the issues I have or is just not his specialty or web devs just don't know seo...lol.... Is obvious a lot of SEO's don't make the changes themselves but leave it up to the devs to handle it their suggestions and fixes. But from my experience devs are not so well versed in seo and you have a hard time knowing if they are doing it correct or can even do it.(of course they will say they can they want your cash and i understand that ). In particular a good amount of wordpress devs claim to know seo but i find that far from the truth.Even when guided to issues some of them will often leave you disappointed. Sorry for my rant! Now to my question , obviously not many SEO's make the actual code changes themselves (how i wish i knew a one that did) are their ones out their that do? If not how do i find a good wordpress dev that can make proper seo changes and knows his stuff....example i need someone who can trouble shoot and track down some serious GWT I have and deal with some hardcore 404 & 301 issues . A lot claim to know but when push comes to shove I have been left disappointed. Thanks in advance for your help and suggestions or recommendations.

Is the 'too many links' caused by the tags?
Hello Just got my seomoz report and decided I better start takiling things. Got a lot of 'too many links' on the report. I don't have control over website design and before I talk to designer I thought I should have a bit of an handle on what I am talking about. I've taken one page that has 483 links. Could Website redesign be a cause of drop in rankings?
We had a complete redesign of our website and moved it over to wordpress several months ago. As url's changed, we had appropriate 301 redirects done. Rankings for our top keywords dropped, but others remained intact. Our SEO company told us rankings drop when a redesign is done, but I thought if we did all redirects properly (which they approved), it wouldn't be much of a problem. Additionally, we've been steadily adding good new content. Any advice?
