Wordpress themes causing google penalty(need experts to settle a debate)

Hi, I have been having a disagreement with another online marketing company. We are both promoting the same product under a different brand name but we ended up using the same theme to build our WordPress sites off of but in no way is the content the same.
They are telling me that using the same theme in the same industry will cause a Google penalty. I do not believe this and do not see this causing a problem. The sites are relatively new so there is no proof of traffic dropping or penalties as of yet.
What is everyone's professional opinion on this? Can a WordPress theme cause duplicate content penalty? If so would that not mean that anyone using themes will have some sort of penalty?

This is exactly what I thought I am not sure why they are so confident that this will cause a penalty. The structure of the sites are definitely different a no links have been made between them as they are essentially two site competing in the same market under different brands.
I am going to send them this thread so I can finally end this ongoing debate. Its a waste of my time.

The theme generally doesn't matter at all. As long as the content is unique on your site, then there's no problem whatsoever. Like previously mentioned, there are plenty of people using the same WordPress theme, and it's the content that's unique, not the theme.

It's a pretty straight forward 'no' Tyson. If all that is used that is the same is the theme, there is no penalty to be handed out here.
If they are concerned about it, tell them to change their theme, but you don't need to worry about this at all

I think that if you have completely different content this should not be an issue.
You should also notice you guys are not
- using the same phone / visible email address
- linking between each other (tough its only 2 sites)
- have the exact same structure
My other recommendation is that one of you change the structure (not the theme)... each theme - or at least the good ones allow you to create a different structure, different widgets, different icons and similar structure related items.
For example you can use additional tabs in your homepage, use different widgets in your footer and so fourth.
Keep in mind that many people buy the same theme and in a world where themes are content related in many cases meaning real-estate themes, transportation themes and so on it not logical that Google would rate a site just based on the theme.

Why is Google displaying meta descriptions for pages that are nowhere contained in said page metas?
Certain search keywords are pulling up incorrect page titles and meta descriptions for our site. I've looked through our code, and the text used by Google in the search results is nowhere found inside our site. I've also looked at previous iterations of our site from over a decade ago and still haven't found it. I then searched specifically for the exact phrased incorrect meta descriptions and found a long list of spammy sites linking to our domain with the exact, incorrect meta description. Is this why Google is displaying the incorrect data, and how do I get Google to use the meta descriptions from my actual site?

Best Practice issue: Modx vs Wordpress
Lately I've been working a lot with Modx to create a new site for our own firm as well for other projects. But so far I haven't seen the advantages for SEO purposes other then the fact that with ModX you can manage almost everything yourself including snippets etc without to much effort. Searching for BEST e-Commerce Multilanguage Platform, Need Advice
I have 2 online store in Canada. Both are selling One bilingual (English&french) Filtration Montreal and a unilinguale store Furnace Filters Canada Both are offering the same products at the same price for Canadian. We work hard to rank on Google.ca because we only sell and ship to Canada. The platform of Filtration Montreal is very basic and limited. For example, the url structure make it very hard to rank on Google.ca This platform is very not SEO friendly with url like: http://www.filtrationmontreal.com/en/product/honeywell-genuine-filter-95/pack-of-5-genuine-honeywell-furnace-filters-20x20x5-601.html The only good thing about this platform, is the multilingual option. The customer can shop in french or English. I would like to move that store to a new platform where I can create a multilingual online store. Do you have sugestions? Using SEOmoz tools and new to SEO, high competitive keywords like: furnace filters, furnace filter are ranking on 3rd rank in Google.ca fist page! This site is getting more & more visitors every months. The only frustrating thing is the English only version of the stores to customers. QUESTIONS: What will be the SEO impact if I'm moving Furnace Filters Canada to a new platform? Do you have suggestions in finding the perfect multilanguage e-Commerce platform?
