Wordpress themes causing google penalty(need experts to settle a debate)

Hi, I have been having a disagreement with another online marketing company. We are both promoting the same product under a different brand name but we ended up using the same theme to build our WordPress sites off of but in no way is the content the same.
They are telling me that using the same theme in the same industry will cause a Google penalty. I do not believe this and do not see this causing a problem. The sites are relatively new so there is no proof of traffic dropping or penalties as of yet.
What is everyone's professional opinion on this? Can a WordPress theme cause duplicate content penalty? If so would that not mean that anyone using themes will have some sort of penalty?

This is exactly what I thought I am not sure why they are so confident that this will cause a penalty. The structure of the sites are definitely different a no links have been made between them as they are essentially two site competing in the same market under different brands.
I am going to send them this thread so I can finally end this ongoing debate. Its a waste of my time.

The theme generally doesn't matter at all. As long as the content is unique on your site, then there's no problem whatsoever. Like previously mentioned, there are plenty of people using the same WordPress theme, and it's the content that's unique, not the theme.

It's a pretty straight forward 'no' Tyson. If all that is used that is the same is the theme, there is no penalty to be handed out here.
If they are concerned about it, tell them to change their theme, but you don't need to worry about this at all

I think that if you have completely different content this should not be an issue.
You should also notice you guys are not
- using the same phone / visible email address
- linking between each other (tough its only 2 sites)
- have the exact same structure
My other recommendation is that one of you change the structure (not the theme)... each theme - or at least the good ones allow you to create a different structure, different widgets, different icons and similar structure related items.
For example you can use additional tabs in your homepage, use different widgets in your footer and so fourth.
Keep in mind that many people buy the same theme and in a world where themes are content related in many cases meaning real-estate themes, transportation themes and so on it not logical that Google would rate a site just based on the theme.

Do Wordpress sites outrank SquareSpace?
I was a big fan of Wordpress. I used it for 10 years. However, because I run a very small business, the constant upkeep needed on WP in the end started to frustrate me in the end, so I moved to SquareSpace. However, I am beginning to question my decision, as one of my sites is struggling really badly, and I mean badly. The other sites are okay. Google Translate with "no-follow" just for users' use, no ranking
Hello, I tried to search but here is a little unique situation. I would like to translate my website in 2-3 different languages not for ranking purpose, but only for some minority users within Italy to understand the content in their native language. Using "no-follow" with a Google Translate link would damage SEO? if not I would like to use it. Here are few points: Give users the ability to switch the content to their language with a link Tell Google not to follow the translated pages, because I don't want them to be used for ranking or searches I would start simply with Google Translate to see if people actually are interested, then later translate by human but still don't want google to follow I could also start with human translation instead of Google Translate if really needed, I know it is a no no. What I'm very interested is to make sure that those pages under "no-follow" won't affect my SEO in good or bad right now, because we would like to keep as it is. Thanks a lot

Duplicate page title caused by Shopify CMS
Hi, We have an ecommerce site set up at devlinsonline.com.au using Shopify and the MOZ crawl is returning a huge number (hundreds!) of Duplicate Page Title errors. The issue seems to be the way that Shopify uses tagging to sort products. So, using the 'Riedel' collection as an example, the urls devlinsonline.com.au/collections/riedel-glasses/ devlinsonline.com.au/collections/riedel-glasses/decanters devlinsonline.com.au/collections/riedel-glasses/vinum all have the exact same page title. We are also having the same issue with the blog and other sections of our site. Is this something that is actually a serious issue or, perhaps, is Google's algorithm intelligent enough to recognise that this is part of Shopify's layout so it will not negatively affect our rankings and can, essentially, be ignored? Thanks.

Affected by the Penguin 2.0...Lost Rankings!! Which one from the following causes did that?
Hi Moz Community, we lost our rankings for almost all of our keywords due to penguin 2.0 I'm trying to rectify the situation by getting our rankings back and better. Here are the potential causes for our rankings drop. 1. My Company has the exact same site (in English) on different country-specific domains. companyname.com, companyname.ch, companyname.ca, companyname.nl etc.. We are using link rel="alternate" hreflang="en" href="http://companyname.com" **Would this solve the duplicate content issue? ** 2. All the international domains have footer links in the homepages, pointing to our main .com site. Google webmaster tools shows that every page on these international domains as a backlink source. Would that be a problem? Should I ask our web designers to remove those footer links from the international domains? 3. In the past, our company had a partnership with forum...Like the forum promotes our company's services. I don't know how did that forum promoted our site, But Google webmaster tools shows that we have some 25K backlinks from that forum!!! But when I try to visit those backlinks, none of those pages have any links to our site....Could they be hidden? Or Some thing wrong with GWT? I need to buy a website template with seo focus - any tip? what technology is better?
Due to lack of resources, my company usually buys website templates and we adjust it internally. So we can always be with new designs, spending less money. With all this changes of google panda recently, I will change my website again. Usually we buy then from templatemonster, but some templates are far away from seo standards.
